Action in the Redwood County District Court brought by Richard Ourada, individually and as parent and natural guardian of Rick Ourada, a minor, to recover for personal injuries to said minor and for consequential damages arising out of an accident on premises leased from defendant. Defendant filed a cross-claim against plaintiff and a third-party complaint against Vicki Ourada, the minor's mother, both for indemnity or contribution. The case was tried before L. J. Irvine, Judge, and a jury, which found in a special verdict that the negligence of defendant contributed 70 percent to the accident; the negligence of Richard Ourada 30 percent; that the mother was not negligent; that the minor's damages amounted to $2,000; and that the father's damages were $400. Accordingly, the court ordered judgment for the minor plaintiff against defendant for $2,000; for the father against defendant for $280; and for defendant against the father for $600. Plaintiff appealed from an order denying his motion for dismissal of the cross-claim, and defendant filed a notice of review to review an order denying his motion for judgment notwithstanding the verdict.
